1.0 Introduction
The access to and continuing use of this website constitutes the full acknowledgment and acceptance of the following terms and conditions by you (“the User”):
The International Trade Centre is a joint subsidiary organ of the World Trade Organization and the United Nations and enjoys, pursuant to inter alia the Convention on the Privileges and Immunities of the United Nations adopted by the General Assembly of the United Nations on 13 February 1946, such privileges and immunities as are necessary for the independent fulfilment of its purposes. Nothing in or relating to this Site shall constitute or imply the waiver by ITC of any of its privileges and immunities.
The International Trade Centre UNCTAD/WTO (hereafter referred to as the “International Trade Centre” or “ITC” or the “Organization”) maintains this website (the “Site”) as a courtesy to those who may choose to access the Site (“Users”). The information presented herein is for informative purposes only and does not constitute advice of any sort. The ITC assumes no liability for the content of the Site. The International Trade Centre does not guarantee the quality, appropriateness, accurateness and fitness for purpose of the information and links contained in the Site.
The International Trade Centre grants permission to Users to visit the Site and to use its link to subdomains (“Subdomains”) for the User’s professional activities, subject to the terms and conditions outlined below. For avoidance of doubt, the Site only hosts the Subdomain and in no case ITC is in charge of any Subdomain. All Subdomains are independent from ITC, and the parties in charge of such Subdomains are responsible to choose all details to perform their own activities.
The International Trade Centre administers only the Site. All Subdomains that are hosted on the Site are subject to their own terms and conditions.
2.0 Disclaimers
(2.1) ITC shall not be liable for any activities or services performed on the Subdomain. In no event ITC shall be liable for direct, indirect, remote, special or consequential damages suffered by the User of its use of any Subdomain hosted by the Site, including commercial damage, loss of profits losses of future businesses, losses of production and cancellation of contracts. The Site is hosting the Subdomain “as is”, and ITC makes no warranties of any kind on use made by the Users of the Subdomain and the activities or services set out in such Subdomain. The use of the Subdomains are at the Users own risks.
This Site contains Subdomains that provide link to other third-party websites. Such websites provide online commercial activities such as but not limited to sales of clothes, accessories. Nothing on this Site, nor ITC, shall be construed or interpreted in any manner as providing any kind of recommendation or endorsement of any commercial activity or brand and should not be relied on as it is given for any decision you make. ITC shall have no involvement in commercial transactions. You (as the User) can acquire the e-commerce facilities with the provider of their choice outside the ITC platform.
(2.2) The User specifically acknowledges and agrees that the International Trade Centre and its parent organizations are not liable for any conduct of any User or third-party.
(2.3) This Site may contain advice, opinions and statements of various information providers from other sources other than ITC. The International Trade Centre does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any information provider, any User of this Site or any other person or entity. Reliance upon any such advice, opinion, statement, or other information shall also be solely at the User’s own risk .
(2.4) As a condition of use of this Site, the User agrees to, at its own expense, indemnify defend, and hold and save harmless, the International Trade Centre and its officials, agents and employees, from and against any and all actions, demands, suits, proceedings, claims, losses, damages, liabilities and expenses of any kind or nature brought by any third party against ITC (including but not limited to, all litigation costs and expenses, attorney’s fees, settlement payments and damages ) based on, related to and arising out of the User’s use of this Site, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms and Conditions.
3.0 Preservation of Immunities
(3.1) Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the International Trade Centre, which are specifically reserved.
4.0 General
(4.1) The International Trade Centre reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site. The International Trade Centre shall have no obligation to take the needs of any User into consideration in connection therewith.
(4.2) The International Trade Centre reserves the right to deny in its sole discretion any user access to this Site or any portion thereof without notice and without any compensation.
(4.3) No waiver by the International Trade Centre of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
